The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The County Council of Humberside (Stoneferry Bridge, Kingston Upon Hull) Scheme 1987 is hereby confirmed with modifications.

2.  The said Scheme as confirmed (hereinafter referred to as “the Scheme”) is set out in the Schedule hereto and copies of the Scheme with its accompanying plans are deposited at the offices of the Department of Transport, Romney House, 43 Marsham Street, London SW1 3PY, at the offices of the Humberside County Council, County Hall, Beverley and at the offices of the Kingston Upon Hull City Council, the Guildhall, Kingston Upon Hull.

3.  The Scheme will come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

4.  This Instrument may be cited as the County Council of Humberside (Stoneferry Bridge, Kingston Upon Hull) Scheme 1987 Confirmation Instrument 1987.

THE SCHEDULE TO THE INSTRUMENTTHE COUNTY COUNCIL OF HUMBERSIDE (STONEFERRY BRIDGE, KINGSTON UPON HULL) SCHEME 1987

The County Council of Humberside (hereinafter referred to as “the Council”) make this scheme in exercise of its powers under section 106(3) of the Highways Act 1980 and all other enabling powers:—

1.  The Council are authorised to construct over the navigable waters of the River Hull the Bridge specified in the Schedule to the Scheme as part of the highway which the Council are proposing to construct to link Clough Road (A1165) and Ferry Lane (A1165) between the east and west banks of the River Hull at a point approximately 13.5 metres north of the existing Stoneferry Bridge, at Stoneferry in the City of Kingston Upon Hull in the County of Humberside.

2.  This Scheme may be cited as the County Council of Humberside (Stoneferry Bridge, Kingston Upon Hull) Scheme 1987.

THE SCHEDULE TO THE SCHEMEPLANS AND SPECIFICATIONS OF THE STONEFERRY BRIDGE

Location

The location and the general design of the bridge are shown on the location plan the general layout plan and the design plan numbered 26/13/01/25/P30C, numbered 26/13/01/25/P42A and 26/13/01/25/P38A sealed with the Common Seal of the Council on 26 March 1987 and deposited at the offices of the Council, County Hall, Beverley, North Humberside.

The bridge will cross the River Hull on two decks. One will be on the site of the existing Stoneferry Bridge. The second will be upstream of the existing bridge, crossing the west bank of the river at a point 15 metres north and the east bank of the river at a point 11 metres north of the existing bridge, both points being marked A and B respectively on the said general layout plan.

Construction

The bridge will comprise steel superstructures and reinforced concrete abutments on piled foundations.

Span

Each deck will have a single opening span of 32 metres.

Width

Each deck will have a width of 13 metres, being marked C on the said general layout plan.

Waterway

Each deck will have a minimum clear navigable waterway of 24 metres at the Statutory Defence Level of 4.65 metres above Ordnance Datum Newlyn.

Headway

When raised, each deck will be pivoted to a vertical position on the west bank completely clear of the river.

When lowered, each deck will have a headway of 1.3 metres above High Water Ordinary Spring Tides, when the depth of water is 3.5 metres above Ordnance Datum Newlyn.

GIVEN under the Common Seal of the Council this twenty sixth day of March 1987.

Explanatory Note

(This note is not part of the Instrument)

The text of the Scheme has been modified—

(a)to avoid confusion about the road described in paragraph 1 of the Schedule and to correct the year cited in paragraph 2 thereof, and

(b)so that the reference to the relevant plans is to them being deposited at the office of the County Council, not to them being attached to the Scheme.
