WAGES COUNCILS

The Wages Councils (Meetings and Procedure) Regulations 1987

The Secretary of State, in exercise of the powers conferred on him by section 25 of, and paragraph 7 of Schedule 2 to, the Wages Act 1986(1)(a) and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Wages Councils (Meetings and Procedure) Regulations 1987 and shall come into force on 4th June 1987.

(2) In these Regulations —

“member” means a person for the time being appointed to be a member of a wages council;

“representative member” means a member appointed to represent employers or workers;

“independent member” means a member appointed as being an independent person;

“chairman” means the independent member acting as chairman of any meeting of a wages council by virtue of an appointment made by the Secretary of State under paragraph 3 of Schedule 2 to the Wages Act 1986.

Revocation

2.  The Wages Councils (Meetings and Procedure) Regulations 1975(2)(b) and the Wages Councils and Central Co-ordinating Committees (Conditions of Office) Regulations 1975(3)(c) are hereby revoked.

Quorum

3.  In order to constitute a meeting of a wages council there shall be present at least one of the independent members and at least one third of the whole number of the representative members.

Voting

4.  Subject to regulation 5, every member of a wages council present at a meeting of the council shall have one vote.

5.—(1) If the chairman of a meeting of a wages council thinks fit, or if more than half of the representative members present who represent employers, or who represent workers, request, a vote of the representative members shall be taken by sides and the vote of the majority of representative members present on each side shall be the vote of that side.

(2) On such a vote, the independent members shall not vote but in the event of the vote resulting in a disagreement between the two sides, the question may be decided by the majority vote of the independent members present or, if the chairman is the only independent member present, by the vote of the chairman.

Notice of meetings

6.  Notice of a meeting of a wages council shall be deemed to be sufficiently given to a member if sent by post to his ordinary or last known address, but the accidental omission to give notice of a meeting to, or the non-receipt of notice of a meeting by, any member shall not invalidate the proceedings at any meeting.

Explanatory Note

(This note is not part of the Regulations)

These Regulations prescribe procedures which are to apply to the meetings of wages councils and relate to the quorum, the method of voting and notices of meetings. The Regulations revoke and replace the Wages Councils (Meetings and Procedure) Regulations 1975 and also revoke the Wages Councils and Central Co-ordinating Committees (Conditions of Office) Regulations 1975.
