The Secretaries of State concerned with health in England, in Wales and in Scotland and the Department of Health and Social Services for Northern Ireland, acting jointly, in exercise of powers conferred by sections 87(1) and 129(5) of the Medicines Act 1968 (1)and now vested in them(2) and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by the following Regulations, pursuant to section 129(6) of that Act, and after taking into account the advice of the Medicines Commission pursuant to section 129(7) of that Act, hereby make the following Regulations:—
1. These Regulations which may be cited as the Medicines (Child Safety) Amendment Regulations 1987, shall be read as one with the Medicines (Child Safety) Regulations 1975(3) (hereinafter referred to as“the principal Regulations”), and shall come into force on 4th June 1987.
2. Regulation 2(3) is amended in accordance with the following provisions:—
(1) In regulation 2(3)(b), for the words“British Standard 5321 published on 31st October 1975 as amended by AMD 2077 published on 16th August 1976”, there are substituted the words“British Standard 6652 published by the British Standards Institution on 30th September 1985”.
(2) In regulation 2(3)(d) after the words“1st January 1976”there is added the word“or”.
(3) After regulation 2(3)(d) there is added:—
“(e) reclosable containers which are opaque or dark-tinted, identical in all respects to containers which comply with the requirements of British Standard 5321 published on 31st October 1975 as amended by AMD 2077 published on 16th August 1976 and which—
(i)have been certified by the British Standards Institution as complying with those requirements, or
(ii)until 31st January 1988, are certified by the British Standards Institution as complying with those requirements, or
(iii)are part of a series of containers (referred to in the said AMD 2077 published on 16th August 1976) in respect of which the licensing authority has already been furnished with a report by the British Standards Institution, so as to enable the licensing authority to publish a notice in the Gazette to the effect that such containers comply with the requirements of British Standard 5321 as amended. ”

These Regulations further amend the Medicines (Child Safety) Regulations 1975 which prohibit the sale or supply of certain aspirin or paracetamol other than in child resistant containers. Regulation 2(1) substitutes for the reference to British Standard 5321 (published in 1975) a reference to British Standard 6652 (published in 1985). Regulations 2(2) and (3) make transitional arrangements, and make special provision for containers which form part of a series.
The British Standard referred to in the Regulations may be obtained from any of the sales outlets operated by the British Standards Institution or by post from the Institution at Linford Wood, Milton Keynes MK14 6LE.
In the case of the Secretaries of State concerned with health in England and in Wales by virtue of article 2(2) of, and Schedule 1 to, the Transfer of Functions (Wales) Order 1969 (S.I. 1969/388) and in the case of the Department of Health and Social Services for Northern Ireland by virtue of section 40 of, and Schedule 5 to, the Northern Ireland Constitution Act 1973 (c. 36), and section 1(3) of, and paragraph 2(1)(b) of Schedule 1 to the Northern Ireland Act 1974 (c. 28).
