The Medicines (Products Other Than Veterinary Drugs) (General Sale List) Amendment Order 1987

The Secretary of State concerned with health in England, the Secretaries of State respectively concerned with health and with agriculture in Wales and in Scotland, the Minister of Agriculture, Fisheries and Food, the Department of Health and Social Services for Northern Ireland and the Department of Agriculture for Northern Ireland, acting jointly, in exercise of powers conferred by sections 51 and 129(4) of the Medicines Act 1968(1) and now vested in them(2) and of all other powers enabling them in that behalf, after consulting such organisations as appear to them to be representative of interests likely to be substantially affected by this Order pursuant to section 129(6) of that Act, and after consulting and taking into account the advice of the Medicines Commission pursuant to section 129(7) of that Act, hereby make the following Order:

Citation, interpretation and commencement

1.—(1) This Order, which may be cited as the Medicines (Products Other Than Veterinary Drugs) (General Sale List) Amendment Order 1987, amends the Medicines (Products Other Than Veterinary Drugs) (General Sale List) Order 1984(3) (hereinafter referred to as “the principal Order”) and shall come into force on 1st June 1987.

(2) In this Order, unless the context otherwise requires, a reference to inserting an entry in a column in a Table of a Schedule to the principal Order shall be construed, in the case of an entry to be inserted in column 1, as a reference to inserting that entry at the appropriate point in the alphabetical order of the entries in column 1 of that Table and, in the case of an entry to be inserted, as the case may be, in column 2 or 3, as a reference to inserting that entry so as to appear against the column 1 entry against which it is listed in this Order.

Amendment of Schedule 1 to the principal Order

2.—(1) Schedule 1 to the principal Order (which specifies the class of medicinal products, other than products the subject of a product licence of right, on general sale by virtue of article 2(a) of the principal Order), is amended in accordance with the following paragraphs of this article.

(2) In Table A (internal or external use)—

(a)there are inserted in column 1 and, as the case may be, columns 2 and 3, those entries set out in columns 1, 2 and 3 respectively of Schedule 1 to this Order, and

(b)for the entries in columns 1, 2 and 3 relating to the substances “Aloxiprin” and “Aspirin” there are respectively substituted the entries set out in Schedule 2 to this Order.

(3) In Table B (external use only)—

(a)there are inserted in column 1 and, as the case may be, column 2, those entries set out in columns 1 and 2 respectively of Schedule 3 to this Order, and

(b)there are deleted from column 1 the entries “Dichloroxylenol” and “Sassafras Oil” and from column 2 the entries relating to those substances.

Amendment of Schedule 2 to the principal Order

3.—(1) Schedule 2 to the principal Order (which specifies the class of medicinal products, the subject of a product licence of right, on general sale by virtue of article 2(b) of the principal Order), is amended in accordance with the following paragraphs of this article.

(2) In Table A (internal or external use)—

(a)for the entries in columns 1, 2 and 3 relating to the substances “Aloxiprin” and “Aspirin” there are respectively substituted the entries set out in Schedule 4 to this Order, and

(b)there are deleted from column 1 the entries “Birthwort”, “Inositol Nicotinate”, “Sassafras” and “Serpentary”.

(3) In Table B (external use only) there are deleted from column 1 the entries “Safrole” and “Sassafras Oil”.

Amendment of Schedule 3 to the principal Order

4.  In Schedule 3 to the principal Order (which specifies classes of medicinal products which are not on the general sale list), the word “or” is deleted from paragraph (e) and is inserted at the end of paragraph (f) and after paragraph (f) there is inserted, “(g) for administration wholly or mainly to children being a preparation of Aloxiprin or Aspirin”.

Explanatory Note

(This note is not part of the Order)

This Order amends the Medicines (Products Other Than Veterinary Drugs) (General Sale List) Order 1984 (referred to as “the principal Order”) which specifies classes of medicinal products which can with reasonable safety be sold or supplied otherwise than by or under the supervision of a pharmacist (the general sale list) and classes of such products which can with reasonable safety be sold by means of automatic machines (the automatic machines section of the general sale list).

The amendments made by this Order are as follows:

Article 2 amends Schedule 1 to the principal Order (medicinal products, other than products the subject of a product licence of right, on general sale), by inserting certain entries, deleting certain entries and also by substituting new entries in respect of the substances Aloxiprin and Aspirin.

Article 3 amends Schedule 2 to the principal Order (medicinal products, the subject of a product licence of right, on general sale), by deleting certain entries and also by substituting new entries in respect of the substances Aloxiprin and Aspirin.

Article 4 amends Schedule 3 to the principal Order (medicinal products which are not on the general sale list), by excluding from general sale preparations of Aloxiprin or Aspirin promoted, recommended or marketed wholly or mainly for administration to children.

In the case of the Secretaries of State concerned with health in England and in Wales by virtue of article 2(2) of, and Schedule 1 to, the Transfer of Functions (Wales) Order 1969 (S.I. 1969/388), in the case of the Secretary of State concerned with agriculture in Wales by virtue of article 2(3) of, and Schedule 1 to, the Transfer of Functions (Wales) (No. 1) Order 1978 (S.I. 1978/272) and in the case of the Northern Ireland Departments by virtue of section 40 of, and Schedule 5 to, the Northern Ireland Constitution Act 1973 (c. 36), and section 1(3) of, and paragraph 2(1)(b) of Schedule 1 to, the Northern Ireland Act 1974 (c. 28).
