LEGAL AID AND ADVICE, SCOTLAND

The Legal Aid Act 1988 (Commencement No. 2) (Scotland) Order 1988

The Secretary of State, in exercise of the powers conferred on him by section 47(3) of the Legal Aid Act 1988(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

1.  This Order may be cited as the Legal Aid Act 1988 (Commencement No. 2) (Scotland) Order 1988.

2.  The following provisions of the Legal Aid Act 1988 shall come into force on 29th July 1988:—

(a)section 44, insofar as it relates to the amendments made by the provisions specified in paragraph (b) below;

(b)in Schedule 4, paragraphs 1, 2, 4, 5A, 6, 7, 8 and 9.

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 29th July 1988 the following provisions of Schedule 4 to the Legal Aid Act 1988, all of which amend the Legal Aid (Scotland) Act 1986 (c. 47)

(a)Paragraph 1 (payments out of the Scottish Legal Aid Fund);

(b)Paragraph 2 (expenses in favour of certain assisted persons);

(c)Paragraph 4 (restriction on payment and employment of solicitor or counsel);

(d)Paragraph 5A (regulations);

(e)Paragraphs 6, 7 and 8 (expenses of unassisted party);

(f)Paragraph 9 (Board’s property to be rateable).
