The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1), and now vested in him(2), and of all other enabling powers:

1.  The lengths of the trunk road described in an item in column 2 of the Schedule to this Order and given the reference letters A, B, C and D in column 3 of that Schedule and shown by broad striped hatching on the deposited plan shall as from the date on which the Secretary of State for Transport notifies the Council whose name is specified in that item in column 4 of that Schedule that the new motorway from Umberslade to Warwick is open for through traffic cease to be trunk road and be classified as principal road.

2.  Each of the lengths of the trunk road described in an item in column 2 of the Schedule to this Order and given the reference letters E, F, G, H, J and K in column 3 of that Schedule and shown by broad striped hatching on the deposited plan shall as from the date on which the Secretary of State for Transport notifies the Council whose name is specified in that item in column 4 of that Schedule that the new motorway from Warwick to Wendlebury is open for through traffic cease to be a trunk road and be classified as a classified road in the case of the lengths given the reference letters F, H, J and K in column 3 of that Schedule and as a principal road in the case of the lengths given the reference letters E and G in column 3 of that Schedule.

3.  In this Order:–

(1) All measurements of distance are measured along the route of the relevant highway;

(2) (i) “classified road” as a classification for a highway, means that the highway is not a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;

(ii)“principal road” as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State;

(iii)“the deposited plan” means the plan numbered HA 10/2 WMRO (L) VI marked “The A41 London–Birmingham Trunk Road (Bicester to South of Knowle) De-Trunking Order 1989”, signed by authority of the Secretary of State and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

(iv)“the trunk road” means the London–Birmingham Trunk Road (A41);

(v)“the new motorway” means the motorway to be provided by the Secretary of State in pursuance of the M40 London– Oxford–Birmingham Motorway (Umberslade to Warwick Section) and Connecting Roads Scheme 1976(3), and the M40 London–Oxford–Birmingham Motorway (Waterstock to Warwick Section) and Connecting Roads (No.1) Scheme 1984(4), (No.2) Scheme 1985(5), and (Supplementary) Scheme 1985(6).

4.  This Order shall come into force on 18th December 1989 and may be cited as the A41 London–Birmingham Trunk Road (Bicester to South of Knowle) De-Trunking Order 1989.
