The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by sections 16(1), (1A)(e), (5)(a), (5A) and (8) and 38(1) of the Plant Varieties and Seeds Act 1964(1) and of all other powers enabling them in that behalf, after consultation in accordance with the said section 16(1) with representatives of such interests as appear to them to be concerned, hereby make the following Regulations:

Title and commencement

1.  These Regulations may be cited as the Seeds (Fees) (Amendment) Regulations 1990 and shall come into force on 5th April 1990.

Amendment of principal Regulations

2.  The Seeds (Fees) Regulations 1985(2) shall be amended as follows—

(a)regulation 4 (repayment of initial fees in certain circumstances) shall be omitted; and

(b)for Schedules 1 to 6 there shall be substituted Schedules 1 to 6 to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Seeds (Fees) Regulations 1985, by prescribing revised fees in respect of matters arising under the Cereal Seeds Regulations 1985 (as amended), the Fodder Plant Seeds Regulations 1985 (as amended), the Oil and Fibre Plant Seeds Regulations 1985 (as amended), the Beet Seeds Regulations 1985 (as amended), the Vegetable Seeds Regulations 1985 (as amended) and the Seeds (Registration, Licensing and Enforcement) Regulations 1985 (as amended) (regulation 2(a)).

The matters in respect of which the revised fees are prescribed are listed in Schedules 1 to 6 to these Regulations, and the fees which were chargeable before these Regulations came into force, are printed in italics opposite the revised fees.

The Regulations also amend the Seeds (Fees) Regulations 1985 by omitting from those Regulations the power for the appropriate Minister to make, in certain circumstances, a refund of one half of an initial fee which has been paid to him (regulation 2(b)).

Fees are no longer prescribed in respect of certain matters arising under seeds regulations, in particular for the sampling (or re-sampling) of a seed lot for the purposes of an official examination, for an official examination of seed for analytical purity, germination and other seed content, for a special test to verify varietal identity and for the issue of certain official labels.
