Her Majesty, in exercise of the powers conferred on Her by section2(2) of the European Communities Act 1972(1), is pleased, by and with the advice of Her PrivyCouncil, to order, and it is hereby ordered, as follows:

Citation and commencement

1.  This Order may be cited as the European Communities (Designation)(No. 2) Order 1991 and shall come into force on 25th April 1991.

Designation of Ministers or departments

2.—(1) For the purposes of section 2(2) of the European Communities Act1972 the Ministers or government departments specified in column 1 ofthe Schedule to this Order are hereby designated in relation to thematters specified in column 2 of that Schedule.

(2) Where a Minister or government department is designated in relationto any item in column 2 of the said Schedule, then, for the purposes ofthe said section 2(2), that Minister or government department is alsohereby designated in relation to anything supplemental or incidental tothe matters specified in that item.

(3) Where more than one Minister or government department is designatedby this Order in relation to any matter, the designation has effect asrespects the making of regulations by any of them or by more than one ofthem acting jointly.

(4) Regulations made by a Northern Ireland department in pursuance ofthis Order, that are not made jointly with any Minister, shall form partof the law of Northern Ireland and not of any other part of the UnitedKingdom.

SCHEDULE

The Minister of Agriculture, Fisheries and Food and any one or more Secretaries of StateMeasures relating to the control and regulation of genetically modified organisms.
The Secretary of StateMeasures relating to the sale, packaging, labelling and sampling of tobacco products.
The Secretary of StateMeasures relating to safety as regards appliances burning gaseous fuels.
The Secretary of StateMeasures relating to the control of laboratories carrying out tests on chemical products.
The Secretary of StateMeasures relating to consumer protection as regards package travel, package holidays and package tours.
The Secretary of StateMeasures relating to the drawing up, auditing and publication of accounts by partnerships, limited partnerships and unlimited companies.
The Secretary of StateMeasures relating to the publication of individual company accounts and group accounts expressed in European Currency Units.
Any Northern Ireland DepartmentThe preceding items in this column.
The Secretary of StateMeasures relating to firearms and ammunition.
The TreasuryMeasures relating to public procurement.

(This note is not part of the Order)

This is a further Order in the series designating the Ministers who,and departments which, may exercise powers to make regulations conferredby section 2(2) of the European Communities Act 1972 and specifying thematters in relation to which those powers may be exercised.
