The Education (Charlotte Mason College of Education Higher Education Corporation) (Dissolution) Order 1992

In exercise of the powers conferred by section 128(1), (2) and (6) of the Education Reform Act 1988(1) the Secretary of State for Education, having consulted in accordance with subsection (4) of the said section 128, Charlotte Mason College of Education HigherEducation Corporation(2) and the Higher Education Funding Council for England(3), andwith the consent of the University of Lancaster given in accordance with subsection (2) of that section, hereby makes the following Order:

1.  This Order may be cited as the Education (Charlotte Mason College of Education Higher Education Corporation) (Dissolution) Order 1992 and shall come into force on 1st September 1992.

2.  In this Order—

“the Act” means the Education Reform Act 1988; and

“the Corporation” means Charlotte Mason College of Education Higher Education Corporation.

3.—(1) The Corporation is dissolved.

(2) The property, rights and liabilities of the Corporation, other than rights and liabilities under any contract of employment, are transferred to and vest in the University of Lancaster.

4.  Section 127 of the Act shall apply in respect of any person employed immediately before 1st September 1992 by the Corporation to work solely at the institution conducted by the Corporation as if the references in that section—

(a)to the transfer date were to 1st September 1992;

(b)to the transferor authority were to the Corporation; and

(c)to the corporation were to the University of Lancaster.

Explanatory Note

(This note is not part of the Order)

This Order dissolves Charlotte Mason College of Education Higher Education Corporation and transfers the property, rights and liabilities of that Corporation to the University of Lancaster (article 3). Contracts of employment of staff of the Corporation are transferred separately (article 4) by applying Section 127 of the Education Reform Act 1988 (which is concerned with the transfer of staff to higher education Corporations) with appropriate modifications.
