The Oil Lamps (Safety) (Revocation) Regulations 1992

Whereas the Secretary of State has, in accordance with section 11(5) of the Consumer Protection Act 19871, consulted such organisations as appear to him to be representative of interests substantially affected by these Regulations and such other persons as he considers appropriate:

Now, the refore, the Secretary of State in exercise of his powers under section 11 of the said Act, read with article 6 of the Consumer Protection Act 1987 (Commencement No. 1) Order 19872, hereby makes the following Regulations:

These Regulations may be cited as the Oil Lamps (Safety) (Revocation) Regulations 1992 and shall come into force on 3rd February 1992.

The Oil Lamps (Safety) Regulations 19793 and the Oil Lamps (Safety) Regulations (Northern Ireland) 19804 are hereby revoked.

These Regulations revoke the Oil Lamps (Safety) Regulations 1979 and the Oil Lamps (Safety) Regulations (Northern Ireland) 1980 which imposed safety requirements for indoor oil lamps based on the provisions of British Standard BS 2049: 1976 as amended.

Suppliers of oil lamps ordinarily intended for private use or consumption continue to be bound by the duty to supply goods which comply with the general safety requirement under section 10 of the Consumer Protection Act 1987.

Under section 10(3) of the Act goods are not to be regarded as failing to comply with the general safety requirement in respect of, inter alia, any failure to do more in relation to any matter than is required by any standards of safety approved for the purposes of section 10(3) by or under any Regulations made under section 11 of the Act and imposing requirements with respect to that matter.

The Secretary of State has approved British Standard BS 2049: 1985, as amended, under regulation 2 of the Approval of Safety Standards Regulations 1987 (S.I.1987/1911) for the purposes of section 10(3) of the Act.

The approval will take effect on 3rd February 1992 the date on which the 1979 and 1980 Regulations will be revoked by these Regulations.
