Whereas a draft of this Order has been approved by resolution of each House of Parliament:
Now, therefore, in exercise of the powers conferred upon me by section 84(3) and (4) of the Criminal Justice Act 1991(1), I hereby make the following Order:
1. This Order may be cited as the Criminal Justice Act 1991 (Contracted Out Prisons) Order 1993 and shall come into force on the day after the day on which it is made.
2. The Criminal Justice Act 1991 (Contracted Out Prisons) Order 1992(2) is hereby revoked.
3. Subsection (1) of section 84 of the Criminal Justice Act 1991 shall have effect as if the words from “which”, in the first place where it occurs, to the end of paragraph (b), were omitted.
4. Section 87 of the Criminal Justice Act 1991 shall have effect as if subsection (5) were omitted.

Section 84(1) of the Criminal Justice Act 1991 provides that the Secretary of State may enter into a contract with another person for the running by that person of any prison which is established after the commencement of section 84 and is for the confinement of remand prisoners.
The Criminal Justice Act 1991 (Contracted Out Prisons) Order 1992 (S.I. 1992/1656) amended section 84(1) so as to enable the Secretary of State to enter into such a contract for the running of any prison established after the commencement of section 84. That Order is revoked by this Order, which amends section 84(1) so as to enable the Secretary of State to enter into such a contract for the running of any prison whether established before or after that date.
