The Virgin Islands (Constitution) (Amendment) Order 1994

The Queen’s Most Excellent Majesty in Council

Her Majesty, by virtue and in exercise of the powers vested in Her by sections 5 and 7 of the West Indies Act 1962(1) and of all other powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

1.—(1) This Order may be cited as the Virgin Islands (Constitution) (Amendment) Order 1994.

(2) The Virgin Islands (Constitution) Order 1976(2) and this Order may be cited together as the Virgin Islands Constitution Orders 1976 to 1994.

(3) In this Order, “the Constitution” means the Constitution set out in the Virgin Islands (Constitution) Order 1976.

(4) This Order shall come into force on such date as the Governor, acting in his discretion, may appoint by proclamation published in the Gazette.

2.  Section 26 of the Constitution shall be amended by substituting the word “thirteen” for the word “nine”.

3.  Section 27 of the Constitution shall be amended by replacing subsection (2) by the following:—

(2) For the purposes of elections the Virgin Islands shall be a single electoral district and shall return four members to the Council and shall also be divided into nine electoral districts in such manner as may be provided by or under any such law and each such district shall return one member to the Council..

4.  Section 40(1) of the Constitution shall be amended by substituting the word “seven” for the word “five”.

5.  Section 48 of the Constitution shall be amended by substituting the word “three” for the word “two”.

Explanatory Note

(This note is not part of the Order)

This Order makes provision for an additional four elected members of the Legislative Council of the Virgin Islands; and for matters relating to the quorum of the Council and the period between dissolution and a general election.
