21.—(1) Regulation 4 of the Fees Regulations (fees) M1 shall be amended in accordance with the following provisions of this regulation.
(2) In paragraph (4), for the words from “the amount of that fee shall” to the end of the paragraph there shall be substituted—
“the amount of that fee shall be—
(a)in a case where the Secretary of State arranges for the enforcement of the obligation to pay child support maintenance in accordance with the assessment whichever is the less of the following—
(i)the amount specified in paragraph (3); or
(ii)that amount multiplied by the number of complete weeks between the first date in respect of which arrears are due and the date the assessment fee next becomes payable divided by 52;
(b)in any other case an amount equal to the collection fee specified in paragraph (3), multiplied by the number of complete weeks between the first collection date and the date the assessment fee next becomes payable, and divided by 52.”.
(3) In paragraph (5), after the word “terminated” there shall be inserted the words “ except by virtue of regulation 3(3A) above ”.
