The Lord Chancellor, in exercise of the powers conferred on him by section 2(1) of the County Courts Act 1984(1), hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Civil Courts (Amendment) (No. 2) Order 1995 and shall come into force on the following dates:

(a)articles 3(f) and 4(c) on 2nd January 1996;

(b)the rest of the Order on 29th December 1995.

Interpretation

2.  In this Order, “the 1983 Order”means the Civil Courts Order 1983(2), and a Schedule referred to by number alone means the Schedule so numbered in that Order.

Amendments to the 1983 Order

3.  In Schedule 1:—

(a)“Bargoed” shall be deleted from its position in the second column opposite the entry for “Blackwood” in the first column;

(b)“Barry” shall be deleted from its position in the second column opposite the entry for “Cardiff” in the first column;

(c)“Basildon” shall be substituted for “Brentwood” in the second column opposite the entry for “Romford” in the first column;

(d)“Cardigan” shall be deleted from its position in the second column opposite the entry for “Haverfordwest”;

(e)“Llandrindod Wells” shall be deleted from its position in the second column opposite the entry for “Brecon”;

(f)“Otley” shall be deleted from its position in the second column opposite the entry for “Leeds” in the first column.

4.  In Schedule 3:—

(a)the entry relating to “Brentwood” shall be amended to read “Basildon”;

(b)the entries relating to “Bargoed”, “Barry”, “Cardigan” and “Llandrindod Wells” shall be deleted(3);

(c)the entry relating to “Otley” shall be deleted(4).

Explanatory Note

(This note is not part of the Order)

This Order amends the Civil Courts Order 1983 so as to close the County Courts at Bargoed, Barry, Cardigan, Llandrindod Wells and Otley and transfer the County Court at Brentwood to Basildon.

S.I. 1983/713; there are no relevant amendments.

(3)

Directions given on behalf of the Lord Chancellor under section 2(3) of the County Courts Act 1984 will determine which court districts will include the former districts of Bargoed, Barry, Cardigan and Llandrindod Wells County Courts with effect from 29th December 1995.

(4)

A direction given on behalf of the Lord Chancellor under section 2(3) of the County Courts Act 1984 will determine which court districts will include the former district of Otley County Court with effect from 2nd January 1996.
