The Secretary of State for the Environment, in exercise of the powers conferred on him by sections 140(4) and 143(1) and (2) of, and paragraphs 4 and 6 of Schedule 8 to, the Local Government Finance Act 1988(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Non-Domestic Rating Contributions (England) (Amendment) Regulations 1995 and shall come into force on 31st December 1995.

Amendment to the 1992 Regulations

2.—(1) The Non-Domestic Rating Contributions (England) Regulations 1992(2) shall be amended in accordance with the following paragraphs in relation to financial years beginning on or after 1 April 1996.

(2) In paragraph 1(4) of Schedule 1, for “1995” substitute “1996”.

(3) In paragraph 4(4) of Schedule 1, for “1995 is £74,913,000” substitute “1996 is £76,867,000”.

(4) In the Table in Part II of Schedule 1—

(a)for “1.1646” substitute “1.1442”,

(b)for “1.1260” substitute “1.1079”;

(c)omit the words “Isle of Wight,”;

(d)for “1.0599” substitute “1.0466”;

(e)for “1.2538” substitute “1.2238”;

(f)for “1.1277” substitute “1.1206”;

(g)for “1.6802” substitute “1.5802”;

(h)at the end insert the entry:

The council of a county which has the functions of a district council1.0466.

(5) In paragraph 2(12) of Schedule 2 omit the words “except in the financial year beginning on 1st April 1995”, and for “0.97” substitute “0.992”.

(6) Omit the Table in Part II of Schedule 2 and, as respects the financial year beginning in 1996, insert—

Explanatory Note

(This note is not part of the Regulations)

Under Part II of Schedule 8 to the Local Government Finance Act 1988, billing authorities are required to pay amounts (called non-domestic rating contributions) to the Secretary of State. Payments in respect of a provisional amount of the contributions are made during the financial year, final calculations and any adjustments of payments being made after the year ends.

These Regulations amend for 1996 the rules for calculation of contributions contained in the Non-Domestic Rating Contributions (England) Regulations 1992. They alter certain figures used in the calculation of contributions and provisional amounts and make provision, for the purpose of calculating provisional amounts, in relation to areas ceasing to be enterprise zones during the year.

1988 c. 41; section 140 and section 143 were amended by paragraph 69 and paragraph 72 of Schedule 5 to the Local Government and Housing Act 1989 (c. 42, “the 1989 Act”), and paragraphs 4 and 6 of Schedule 8 were amended by paragraph 42 of Schedule 5 to the 1989 Act and by paragraph 6 of Schedule 10 and by paragraph 86 of Schedule 13 to the Local Government Finance Act 1992 (c. 14).
