Regulation 19

SCHEDULE 2AMENDMENTS

The Health and Safety (First-Aid) Regulations 1981

1.  In regulation 7 of the Health and Safety (First-Aid) Regulations 1981(1), in paragraph (a) for the words “the Diving Operations at Work Regulations 1981” substitute “the Diving at Work Regulations 1997”.

The Pressure Systems and Transportable Gas Containers Regulations 1989

2.  In paragraph 7 of Part I of Schedule 2 of the Pressure Systems and Transportable Gas Containers Regulations 1989(2), for the words “regulation 5(1)(d) of the Diving Operations at Work Regulations 1981 and used or intended to be used in the course of a diving operation” substitute “regulation 6(3)(b) of the Diving at Work Regulations 1997 and used or intended to be used in the course of a diving project”.

The Construction (Head Protection) Regulations 1989

3.  In regulation 2 of the Construction (Head Protection) Regulations 1989(3), in paragraph (2) for the words “a diving operation construed in accordance with regulation 2(2)(a) of the Diving Operations at Work Regulations 1981” substitute “a diving project within the meaning of regulation 2(1) of the Diving at Work Regulations 1997”.

The Offshore Installations (Safety Case) Regulations 1992

4.  In regulation 2 of the Offshore Installations (Safety Case) Regulations 1992(4), in paragraph (1) the definition of “diving bell” shall be deleted and the following substituted—

“diving bell” means any compression chamber which is capable of being manned and is used or designed for use under the surface of water in supporting human life being a chamber in which any occupant is or may be subjected to a pressure of more than 300 millibars above atmospheric pressure during normal operation;.

The Reporting of Injuries Diseases and Dangerous Occurrences Regulations 1995

5.  In the Reporting of Injuries Diseases and Dangerous Occurrences Regulations 1995(5)—

  • (a)

    in regulation 2(1)—

    (i)

    for the definition of “diving contractor” there shall be substituted the following definition—

    • “diving contractor” has the meaning assigned to it by the Diving at Work Regulations 1997;; and

    (ii)

    the definition of “diving operation” shall be deleted; and

    (iii)

    after the definition of “diving contractor” there shall be inserted the following definition—

    • “diving project” has the meaning assigned to it by the Diving at Work Regulations 1997; and

    (iv)

    in sub-paragraph (a)(vii) of the definition of “responsible person”, for the words “diving operation” there shall be substituted the words “diving project”.

    (b)

    In paragraph 10 of Part I of Schedule 2, for the words “diving operation” there shall be substituted the words “diving project”.

The Work in Compressed Air Regulations 1996

6.  In regulation 3 of the Work in Compressed Air Regulations 1996(6), in paragraph (2) for the words “to any diving operation as construed in accordance with regulation 2(2)(a) of the Diving Operations at Work Regulations 1981” substitute “to any diving project within the meaning of regulation 2(1) of the Diving at Work Regulations 1997”.

The Confined Spaces Regulations 1997

7.  In the Confined Spaces Regulations 1997(7)—

(a)in regulation 1(2), the definition of “diving operation” shall be deleted and replaced with the following definition—

  • “diving project” has the meaning assigned thereto by regulation 2(1) of the Diving at Work Regulations 1997;; and

(b)in regulation 2, there shall be substituted for paragraph (c) the following paragraph—

any diving project to and in relation to which the Diving at Work Regulations 1997 apply by virtue of regulation 3 of those Regulations..
