The Secretary of State, in exercise of powers conferred on him by sections 16(3)(a), (7) and (9) and 39(2) of the National Health Service (Primary Care) Act 1997(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:—

Citation and commencement

1.  These Regulations may be cited as the National Health Service (Pilot Schemes—Health Service Bodies) Amendment Regulations 1998 and shall come into force on 25th May 1998.

Amendment of the National Health Service (Pilot Schemes—Health Service Bodies) Regulations 1997

2.—(1) The National Health Service (Pilot Schemes—Health Service Bodies) Regulations 1997(2) shall be amended in accordance with paragraph (2).

(2) In regulation 1 (citation, commencement and interpretation), in paragraph (2), in the definition of “application”, after “personal medical services” insert “or personal dental services”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the National Health Service (Pilot Schemes—Health Service Bodies) Regulations 1997 by extending those Regulations to pilot schemes under which personal dental services are, or are to be, provided. Those Regulations (as thus amended) specify the procedure for applications made under section 16 of the National Health Service (Primary Care) Act 1997, by which any person or persons who are providing, or who are proposing to provide, personal dental services can become a health service body for the purposes of section 4 of the National Health Service and Community Care Act 1990 and section 17A of the National Health Service (Scotland) Act 1978. They also state the circumstances in which a health service body arising from an application is to cease to be such a body.

These Regulations impose no costs on business.

1997 c. 46. Section 16 of that Act comes into force on 11th May 1998 in relation to pilot schemes under which personal dental services are provided (see S.I. 1998/631). “Personal dental services” are defined in section 1(8) of that Act.
