The Gaming Act (Variation of Monetary Limits) (No. 2) Order 1998

The Secretary of State, in exercise of the powers conferred on him by sections 31(3), 34(9) and 51(4) of the Gaming Act 1968(1), hereby makes the following Order:

1.  This Order may be cited as the Gaming Act (Variation of Monetary Limits) (No. 2) Order 1998 and shall come into force on 1st October 1998.

2.  For the purposes of section 31(3) of the Gaming Act 1968(2) (which provides for the maximum charge for playing a game once by means of a machine to which Part III of that Act applies on licensed or registered premises) there shall be specified the sum of 50p.

3.  Subsections (5C) and (5D) of section 34 of the Gaming Act 1968(3) (which specify the maximum amount which may be offered as a prize in respect of any one game played by means of a cash-only machine) shall have effect as if, for the sum of £10 specified in those subsections, there were substituted the sum of £15.

4.  Article 2 of the Gaming Act (Variation of Monetary Limits) (No. 2) Order 1997(4) is hereby revoked.

Explanatory Note

(This note is not part of the Order)

This Order increases the monetary limits specified in section 31(3) and 34(5C) and (5D) of the Gaming Act 1968 (c. 65) and described in articles 2 and 3 of the Order.

The sum currently specified for the purposes of section 31(3) is 30p by virtue of S.I. 1997/2079.
