The Chiropractors Act 1994 (Commencement No. 2) Order 1999

The Secretary of State for Health, in exercise of the powers conferred upon him by section 44(3) of the Chiropractors Act 1994(1), hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Chiropractors Act 1994 (Commencement No. 2) Order 1999.

(2) In this Order, “the Act” means the Chiropractors Act 1994.

Appointed day

2.  13th May 1999 is the day appointed for the coming into force of each provision of the Act specified in the first column of the Schedule to this Order (which relate to the matters mentioned in the second column of the Schedule) and, save as otherwise provided in column (1) of the Schedule, those provisions shall come into force on that day for all purposes.

The Statutory Committees, in particular the Education Committee

Explanatory Note

(This note is not part of the Order)

This Order brings into force on 13th May 1999 the following provisions of the Chiropractors Act 1994 which relate to the General Council’s education and training functions and to membership of the statutory committees–

  • section 1(2), under which the Council has a duty to develop, promote and regulate the profession of chiropractic; and section 1(3), under which the Council shall have such other functions as are conferred on it by the Act;

  • section 1(5), section 1(6), section 1(7) and section 1(9) which relate to the statutory committees of the Council one of which is the Education Committee;

  • section 11, under which the Education Committee has the general duty of promoting high standards of education and training in chiropractic and of advising the Council on such matters;

  • sections 12, 13, 14, 15, 16 and 18, which concern the determination from time to time of the standard of proficiency required for the competent and safe practice of chiropractic, the procedure for recognising qualifications and for visiting and obtaining information from institutions offering relevant courses of study;

  • section 33 which applies provisions of the Fair Trading Act and the Competition Act to rules, Codes of Practice and other guidance issued by the General Council;

  • section 39 which adds to section 3 of the Video Recordings Act 1984 (exempted supplies), occupations for the exercise of which a person must be registered under the Osteopaths Act or Chiropractors Act;

  • section 43 in respect of certain definitions; and

  • section 44(8) which relates to the extent of the provisions being brought into force.

The Order also brings into force, section 1(4) and paragraphs 7 and 14(5)(b) in Part I of Schedule 1, which provide for rules to be made setting out the grounds on which a member may be removed from office and the procedure involved; and for the appointment of an acting Chairman.

In addition, the Order brings into force Part II paragraphs 16 to 23 (with the exception of paragraph 21(1)), which relate to the membership and procedure of the statutory committees in general and are brought into force in so far as they relate to the Education Committee and to the appointment and co-option of members to the statutory committees; and paragraphs 25 to 29 which relate to membership and the chairmanship of the Education Committee.
