SCHEDULE 2AMENDMENT OF THE SOCIAL SECURITY BENEFIT (DEPENDENCY) REGULATIONS 1977

Article 3(2)

In regulation 1(2)54 (interpretation), for the definition of “the determining authority” there shall be substituted the following definition–

  • “determining authority” means, as the case may require, the Secretary of State, an appeal tribunal constituted under Chapter I of Part I of the Social Security Act 1998 (“an appeal tribunal”) or a Commissioner within the meaning of section 39(1) of that Act;

In regulation 355 (allocation of contributions for spouse or children) in paragraph (4)(b)–

a

for the words “varied on review” there shall be substituted the word “superseded”;

b

for the words “determining authority” there shall be substituted the words “the Secretary of State”; and

c

subject to sub-paragraph (a) above, for the word “review” in each place in which it occurs there shall be substituted the word “supersession”.
