SCHEDULE 2AMENDMENT OF THE SOCIAL SECURITY BENEFIT (DEPENDENCY) REGULATIONS 1977

In regulation 1(2)54 (interpretation), for the definition of “the determining authority” there shall be substituted the following definition–
“determining authority” means, as the case may require, the Secretary of State, an appeal tribunal constituted under Chapter I of Part I of the Social Security Act 1998 (“an appeal tribunal”) or a Commissioner within the meaning of section 39(1) of that Act;

In regulation 355 (allocation of contributions for spouse or children) in paragraph (4)(b)–
a
for the words “varied on review” there shall be substituted the word “superseded”;
b
for the words “determining authority” there shall be substituted the words “the Secretary of State”; and
c
subject to sub-paragraph (a) above, for the word “review” in each place in which it occurs there shall be substituted the word “supersession”.
