The Secretary of State for Health, in exercise of the powers conferred by sections 121 and 126(4) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Regulations:

Citation, commencement and extent

1.—(1) These Regulations may be cited as the National Health Service (Charges to Overseas Visitors) Amendment Regulations 2000.

(2) These Regulations extend only to England.

Amendment of Regulations

2.  The National Health Service (Charges to Overseas Visitors) Regulations 1989(2) are amended as follows–

(a)by the insertion, after the definition of “overseas visitor” in regulation 1(2), of the following definition–

“Primary Care Trust” means a Primary Care Trust established under section 16A of the National Health Service Act 1977;;

(b)by the insertion, in the definition of “services forming part of the health service”, in regulation 1(2)–

(i)after the words “NHS trust” of the words “or a Primary Care Trust ”,

(ii)after the words “provided under” of the words “section 18A(4) or (5) of the Act (accommodation and services for private patients of Primary Care Trusts and powers of Primary Care Trusts to make more income available), ”;

(c)by the insertion in regulation 1(2), in the definition of “treatment the need for which arose during the visit”, after the words “Authority or NHS trust” of the words “, or a Primary Care Trust”;

(d)by the insertion in paragraphs (1) and (2) of regulation 2 after the words “ Authority or NHS trust” in each place where they occur of the words “ , or a Primary Care Trust”;

(e)by the insertion in paragraph (a) of regulation 4, after the words “ Authority or NHS trust” of the words “, or Primary Care Trust”;

(f)by the insertion in paragraphs (1) and (2) of regulation 8 after the words “ Authority or NHS trust” in each place where they occur of the words “ , or a Primary Care Trust”;

(g)by the deletion from Schedule 2 of the entry “Hong Kong”.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the National Health Service (Charges to Overseas Visitors) Regulations 1989 (“the 1989 Regulations”).

The principal amendments reflect the establishment from 1st April 2000 of Primary Care Trusts under section 16A of the National Health Service Act 1977 (as inserted by the Health Act 1999). The Regulations also remove Hong Kong from Schedule 2 to the 1989 Regulations (countries or territories in respect of which the United Kingdom Government has entered into a reciprocal agreement).

The functions of the Secretary of State under sections 121 and 124(6) are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of The National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672 as amended by section 66(5) of the Health Act 1999.
