The Teaching and Higher Education Act 1998 (Commencement No. 8) Order 2001

In exercise of the powers conferred by sections 42(7) and 46(4) of the Teaching and Higher Education Act 1998(1), the Secretary of State for Education and Employment hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Teaching and Higher Education Act 1998 (Commencement No. 8) Order 2001.

(2) In this Order “the 1998 Act” means the Teaching and Higher Education Act 1998.

Provisions coming into force on 28th February 2001

2.  The following provisions of the 1998 Act shall come into force in relation to England and Wales on 28th February 2001:

  • section 6 to the extent that it relates to the provisions of Schedule 2 specified below;

  • in Schedule 2—

  • paragraph 1;

  • paragraph 2;

  • paragraph 3(4) for the purpose of making regulations under that sub-paragraph;

  • paragraph 3(5);

  • paragraph 5(1) for the purpose of making regulations under that sub-paragraph;

  • paragraph 6(1);

  • paragraph 7; and

  • paragraph 8.

Provisions coming into force on 30th April 2001

3.  The following provisions of the 1998 Act shall come into force insofar as they relate to Wales on 30th April 2001:

  • section 2(4);

  • section 6 in so far as it is not already in force;

  • in Schedule 2—

  • paragraph 3(1), (2) and (3);

  • paragraph 3(4) for remaining purposes;

  • paragraph 4;

  • paragraph 5(1) for remaining purposes;

  • paragraph 5(2); and

  • paragraph 6(2) and (3).

Provisions coming into force on 1st June 2001

4.  The following provisions of the 1998 Act shall come into force insofar as they relate to England on 1st June 2001:

  • section 2(4);

  • section 6 in so far as it is not already in force;

  • in Schedule 2—

  • paragraph 3(1), (2) and (3);

  • paragraph 3(4) for remaining purposes;

  • paragraph 4;

  • paragraph 5(1) for remaining purposes;

  • paragraph 5(2); and

  • paragraph 6(2) and (3).

Explanatory Note

(This note is not part of the Order)

This Order brings into force certain provisions of the Teaching and Higher Education Act 1998 on 28th February, 30th April and 1st June 2001. The provisions are listed in articles 2 to 4. These provisions relate to the disciplinary functions of the General Teaching Council for England and the General Teaching Council for Wales.
