Amendment of Schedule 2 to the principal Order (Scottish Parliamentary Election Rules)
3.—(1) Schedule 2 to the principal Order shall be amended in accordance with this article.
(2) In rule 1(1) (timetable), after “shall” insert “, subject to rule 1A below,”.
(3) In rule 1(2), for “In” substitute–
“Except in relation to the substitutions made by rule 1A below, in”.
(4) After rule 1 insert–
“Timetable - Election to fill vacancy in a constituency seat
1A. In the case of an election under section 9 of the Scotland Act 1998 (constituency vacancies), the proceedings shall be conducted in accordance with the Table in rule 1(1) above, but subject to the following substitutions–
(a)for the first entry in the Table substitute–
| “Publication of notice of election to fill a constituency vacancy. | Not earlier than the twenty-eighth day before the date of the poll and not later than the fourteenth day before the date of the poll.”; and |
(b)for the second entry in the Table substitute–
| “Delivery of constituency nomination papers. | Not later than 4pm on any day after the date of the publication of the notice of election but not later than the eleventh day before the date of the poll.”.” |
