In exercise of the powers conferred on the Secretary of State by sections 19 and 54(3) of the Education Act 1997(1), the Secretary of State for Education and Skills hereby makes the following Regulations:
1. These Regulations may be cited as the Education (School Performance Targets) (England) (Amendment) (No. 2) Regulations 2001 and shall come into force on 14th September 2001.
2. The Education (School Performance Targets) (England) Regulations 1998(2) shall be amended as follows.
3. In regulation 2(1) (interpretation)—
(a)after the definition of “the 1997 Act” there shall be inserted
““the 2000 Act” means the Learning and Skills Act 2000;”(3)
(b)after the definition of “designated school” there shall be inserted
““English” means any external qualification approved by the Secretary of State under section 96 of the 2000 Act with the subject title English but not being English Literature;”
(c)after the definition of “level 4” there shall be inserted
““Mathematics” means any external qualification approved by the Secretary of State under section 96 of the 2000 Act with the subject title Mathematics;”.
4. In regulation 4 for paragraph (3)(b) there shall be substituted the following—
“(b)the percentage of the relevant group of pupils aged 15 to achieve, by the end of the following school year, grades A* to G in five or more subjects including English and Mathematics in GCSE examinations; and”.
5. In regulation 6 for paragraph (5)(b)(ii) there shall be substituted the following—
“(ii)the percentage of pupils aged 15 who achieved grades A* to G in five or more subjects including English and Mathematics in GCSE examinations by the end of that year; and”.

These Regulations amend the Education (School Performance Targets) (England) Regulations 1998 so as to require targets to be set for pupils aged 15 for them to achieve five or more GCSE (or equivalent) grades including English and Mathematics. This replaces the previous requirement to set targets for one or more GCSE (or equivalent) grades.
1997 c. 44; section 19 was amended by the School Standards and Framework Act 1998 (c. 31), Schedule 30, paragraph 213. By virtue of the National Assembly for Wales (Transfer of Functions) Order 1999 (S.I. 1999/672) the powers conferred by these sections are exercisable by the Secretary of State only in relation to England.
S.I. 1998/1532 to which there are amendments not relevant to these Regulations.
