Their Lordships, in exercise of the powers conferred on them by article 48(2) of the Health Professions Order 2001(1), and of all other powers enabling them in that behalf, hereby make the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Health Professions Order 2001 (Transitional Provisions) Order 2002 and shall come into force—

(a)for the purposes of article 2(a)(ii), on the date specified for the coming into force of article 27(a) of the Health Professions Order 2001;

(b)for the purposes of article 2(c), the date specified for the coming into force of article 36 of the Health Professions Order 2001;

(c)for the purposes of the remaining provisions, on 1st April 2002.

(2) In this Order—

“Council” means the Health Professions Council established by article 3 of the Health Professions Order 2001; and

“the Order” means the Health Professions Order 2001.

Transitional Provisions

2.—(1) Until a register is established under article 5(1)—

(a)the expression “registrant” where it appears in the following provisions shall mean “a person registered on one of the registers maintained by the Council pursuant to paragraph 11 of Schedule 2 to the Order”—

(i)article 3(4), (5), (13) and (14),

(ii)article 27,

(iii)article 41(3), and

(iv)Schedule 1, paragraph 17(2)(e)(i) and (iii);

(b)in Schedule 1—

(i)in paragraph 9(2)(c), “part of the register” shall be read as “the register”,

(ii)in paragraph 9(2)(e), the reference to an order made by a Practice Committee shall be read as a reference to a determination made under paragraph 17 or 18 of Schedule 2,

(iii)in paragraph 17(2)(e) and (f), “each part of the register” shall be read as “each register”, and

(iv)in paragraph 17(2)(f) “registrant member” shall be read as “practitioner member”;

(c)a person registered on one of the registers maintained pursuant to paragraph 11 of Schedule 2 to the Order may be appointed as a registrant assessor under article 36.

Explanatory Note

(This note is not part of the Order)

This Order makes transitional provisions under article 48(2) of the Health Professions Order 2001 (“the Order”) to enable consultation and other provisions in the Order to apply, pending the establishment of a register under the Order, to those who are on one of the registers maintained by the Health Professions Council under the transitional provisions in paragraph 11 of Schedule 2 to the Order.
