In the exercise of the powers conferred by section 43(3), (7), and (8) of the Special Educational Needs and Disability Act 2001(1), the Secretary of State for Education and Skills hereby makes the following Order:

Citation and interpretation

1.  This Order may be cited as the Special Educational Needs and Disability Act 2001 (Commencement No. 3) Order 2002.

2.  In this Order references to sections are references to sections of the Special Educational Needs and Disability Act 2001 save where the context specifies otherwise.

Appointed day

3.  The 30th May 2002 is the day appointed for the coming into force of section 31 and, for the purpose of allowing the designation of educational institutions pursuant to sections 28R(6)(c) and 28R(7)(e) of the Disability Discrimination Act 1995(2), of section 26.

Explanatory Note

(This note is not part of the Order)

This Order provides for the coming into force on 30th May 2002 of certain provisions of the Special Educational Needs and Disability Act 2001 for the purpose of allowing two sets of regulations to be made which: (1) designate a number of educational institutions which will become subject to the provisions of Part IV of the Disability Discrimination Act 1995 once further provisions of the Special Educational Needs and Disability Act 2001 have been commenced; and (2) introduce various measures concerning the alteration of leasehold premises in circumstances where those alterations are required to meet obligations created by that Part of that Act.

The provisions of Part 1 (special educational needs) and Part 3 (supplementary) of the Act are in force as summarised below.

Section 43 and the provisions set out in sub-section (4) of that section were brought into force without commencement order as provided by sub-sections (3) and (4); in addition, some of the provisions set out in the Table were brought into force for the purpose of making Regulations on 15/06/01 as respects England (S.I. 2001/2217), and on 08/12/01 (S.I. 2001/3992) and 21/01/02 (S.I. 2002/74) as respects Wales.
