The Homelessness Act 2002 (Commencement No. 1) (England) Order 2002

The Secretary of State, in exercise of the powers conferred upon him by section 20(1) of the Homelessness Act 2002(1) hereby makes the following Order:

Citation and extent

1.—(1) This Order may be cited as the Homelessness Act 2002 (Commencement No. 1) (England) Order 2002.

(2)  This Order extends to England only.

Commencement

2.  The following provisions of the Homelessness Act 2002 shall come into force on 31st July 2002—

  • sections 1 to 7,

  • sections 9 and 10,

  • section 18(1) in so far as it relates to paragraphs 8 to 12, 14(b) to (d), 15, 16, 17(b) and 18 to 21 of Schedule 1,

  • section 18(2) in so far as it relates to repeals in Schedule 2 in—

    (a)

    the Housing Act 1996(2) other than the repeals of sections 161 to 165 and in section 174, and

    (b)

    the Immigration and Asylum Act 1999(3),

  • section 19.

3.  Section 12 of the Homelessness Act 2002 shall come into force on 1st October 2002.

Explanatory Note

(This note is not part of the Order)

This Order brings into force, on 31st July 2002, the following provisions of the Homelessness Act 2002 in relation to England:

  • sections 1 to 4 (homelessness reviews and strategies);

  • sections 5 to 7, 9 and 10 (other functions relating to homelessness);

  • section 19 (financial provision);

  • minor and consequential amendments and repeals.

The Order also brings section 12 (co-operation in certain cases involving children) into force on 1st October 2002.

The following provisions came into force on Royal Assent:

  • section 8

  • paragraphs 3 and 7 of Schedule 1.

2002 c. 7. The powers conferred by section 20(1) are exercisable as respects Wales by the National Assembly for Wales (see section 20(3) of the Homelessness Act 2002).
