The Secretary of State and the Minister of Agriculture, Fisheries and Food, being satisfied that it is expedient to apply section 42(2) of the Wildlife and Countryside Act 1981(1) to the land hereafter mentioned which is comprised in a National Park and which appears to them to consist of or include moor or heath, in exercise of the powers conferred on them by sections 42 and 52(1)(2) of the Wildlife and Countryside Act 1981, hereby make the following Order:

1.—(1) This Order may be cited as the Peak District National Park Authority (Restriction of Agricultural Operations) Order 2002 and shall come into force on 18th January 2002.

(2) In this Order:—

“the Act” means the Wildlife and Countryside Act 1981; and

“the maps” means the maps numbered 1 to 5 titled “Map referred to in the Peak District National Park Authority (Restriction of Agricultural Operations) Order 2002”, of which prints signed on behalf of the Department for Environment, Food and Rural Affairs are deposited and available for inspection at the offices of the Department for Environment, Food and Rural Affairs and the Peak District National Park Authority.

2.  Section 42(2) of the Act (restriction of agricultural operations) shall apply to the land situated within the Peak District National Park and shown hatched on the maps.

3.  The operations listed in the Schedule hereto are specified pursuant to section 42(2)(b) of the Act as agricultural operations which appear to the Secretary of State and the Minister of Agriculture, Fisheries and Food to be likely to affect the character or appearance of the said land.

THE SCHEDULESPECIFIED AGRICULTURAL OPERATIONS PROHIBITED IN ADDITION TO PLOUGHING

1.  Mowing, cutting or removing vegetation.

2.  Levelling or bulldozing.

3.  Modification of natural or man-made features and clearance of boulders, large stones, loose rock or scree.

4.  Cultivating including planting.

5.  Draining.

6.  Application of herbicides or pesticides.

7.  Fertilising.

8.  Erecting buildings, structures or fences.

9.  Depositing anything on the land.

Explanatory Note

(This note is not part of the Order)

This Order applies section 42(2) of the Wildlife and Countryside Act 1981 (which imposes restrictions on agricultural operations) to land within the Peak District National Park shown hatched on the maps referred to in this Order.

The Order also specifies certain agricultural operations which are likely to affect the character or appearance of the land and which are restricted by the Order.

Copies of the maps may be inspected at all reasonable times at the Department for Environment, Food and Rural Affairs, at Temple Quay House, 2 The Square, Temple Quay, Bristol BS1 6EB and at the offices of the Peak District National Park Authority at Aldern House, Baslow Road, Bakewell, Derbyshire DE45 1AE.
