Whereas the Environmental Protection (Restriction on Use of Lead Shot) (England) Regulations 1999(1) (“the principal Regulations”) prohibit the use of lead shot (as defined in those Regulations) for the purpose of shooting with a shot gun certain birds or in certain circumstances;

Now therefore the Secretary of State—

(a)

having, in accordance with section 140(6) of the Environmental Protection Act 1990(2)—

(i)

consulted the committee established(3) under section 140(5) of that Act;

(ii)

published a notice in the London Gazette; and

(iii)

considered the representations made to her in accordance with that notice; and

(b)

considering it appropriate to make these Regulations for the purpose of preventing the substance or article specified in the principal Regulations (namely lead shot) from causing pollution of the environment and harm to the health of animals;

in exercise of the powers conferred on her by section 140(4) of the Environmental Protection Act 1990, hereby makes the following Regulations:

Citation and commencement

1.  These Regulations may be cited as the Environmental Protection (Restriction on Use of Lead Shot) (England) (Amendment) Regulations 2003 and shall come into force on 31st October 2003.

Amendment

2.—(1) Schedule 1 to the Environmental Protection (Restriction on Use of Lead Shot) (England) Regulations 1999 shall be amended as follows.

(2) Delete the following entries—

(3) After the entry in relation to “Turnford And Cheshunt Pits” insert the following entry—

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Environmental Protection (Restriction on Use of Lead Shot) (England) Regulations 1999 (“the 1999 Regulations”) which apply in relation to England only. The 1999 Regulations prohibit the use of lead shot for shooting with a shot gun—

(a)on or over any area below the high-water mark of ordinary spring tides;

(b)on or over the sites of special scientific interest included in Schedule 1 to the 1999 Regulations; or

(c)any wild bird included in Schedule 2 to the 1999 Regulations.

These Regulations remove from Schedule 1 to the 1999 Regulations the following sites of special scientific interest: Avon Valley, River Derwent And Tributaries, Stanford Training Area and The New Forest. They add to Schedule 1 the Tweed Estuary.

Details of the area covered by the sites of special scientific interest listed in the amended Schedule 1 to the 1999 Regulations can be obtained from English Nature at Northminster House, City Road, Peterborough, PE1 1UA.

No Regulatory Impact Assessment has been prepared in respect of these Regulations.
