The Health and Social Care (Community Health and Standards) Act 2003 Commencement (No.2) (Amendment No.2) Order 2004

The Secretary of State for Health, in exercise of the powers conferred on him by section 195(1)(b) and 199(1) of the Health and Social Care (Community Health and Standards) Act 2003(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 2) (Amendment No. 2) Order 2004.

(2) This Order shall come into force on 31st March 2004.

(3) In this Order, “the Order” means the Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 2) Order 2004(2).

Amendments to the Order

2.  In article 6(2)(p) of the Order (repeals relating to primary medical services, general medical services and section 28C arrangements)—

(a)for “Part 1 in so far as it relates” there shall be substituted “Part 1 and section 40(3) in so far as they relate”; and

(b)for “, 32 and 40(3)” there shall be substituted “and 32”.

Explanatory Note

(This note is not part of the Regulations)

This Order corrects an error in the Health and Social Care (Community Health and Standards) Act 2003 Commencement (No. 2) Order 2004. It is intended that the commencement of the repeal of section 40(3) of the National Health Service (Primary Care) Act 1997 (interpretation) (as provided for in article 6(2)(p) of the Order) should relate only to personal medical services and not also to personal dental services.
