(This note is not part of the Regulations)

These Regulations amend the Education (Individual Pupil Information) (Prescribed Persons) Regulations 1999.

The principal amendments are—

a

the deletion of the definition “individual pupil information”, so that nursery schools, which were previously excluded from the scope of these Regulations by virtue of this definition, are now included (regulation 4(a));

b

the substitution of the definition “the relevant local education authority” by the definition “the relevant local authority”, for the purpose of including a local education authority which has responsibility for maintaining that pupil’s statement of special educational needs and a local authority who looks after that child (regulation 4(b));

c

the insertion of a new provision to enable any person holding any individual pupil information (other than the Secretary of State or an information collator) to provide that information to any of the persons prescribed therein (regulation 5(a)); and

d

the insertion of the Learning and Skills Council into the list of prescribed persons (regulation 5(b)).
