The Queen’s Most Excellent Majesty in Council

Her Majesty, in pursuance of section 150(4) of the Broadcasting Act 1996(1), and section 204(6) of the Broadcasting Act 1990(2), as it is applied by section 150(3) of the Broadcasting Act 1996 and in exercise of the powers conferred upon Her by section 20(3) of the Wireless Telegraphy Act 1949(3) as it has effect by virtue of section 9(2) of the Wireless Telegraphy Act 1998(4), section 9(3) of the Wireless Telegraphy Act 1998 and sections 402(3)(b) and (c) and 411(6) and (8) of the Communications Act 2003(5), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Broadcasting and Communications (Isle of Man) Order 2004 and shall come into force on 27th February 2004.

2.—(1) The Broadcasting (Isle of Man) Order 2003(6) is hereby amended in accordance with Part 1 of the Schedule to this Order.

(2) The Communications (Isle of Man) Order 2003(7) is hereby amended in accordance with Part 2 of the Schedule to this Order.

SCHEDULE

PART 1AMENDMENTS OF THE BROADCASTING (ISLE OF MAN) ORDER 2003

In Schedule 1

(a)In paragraph 17, after the word “services” insert the words “, by the BBC or by the holder of a national digital sound programme licence under section 60.”; and

(b)In paragraph 18(d), for the words “subsection (ii)”, substitute “subsection (11)”.

PART 2AMENDMENTS OF THE COMMUNICATIONS (ISLE OF MAN) ORDER 2003

In Schedule 2

(a)In paragraph 17(b), for the words “(2C) and (2D)” substitute “(1C) and (1D)”;

(b)In paragraph 46(c), for “(c)7” substitute “(c)”;

(c)In paragraph 54(b), before “(12)” insert “(11) and”; and

(d)In paragraph 71(f) for “27”, substitute “28”.

Explanatory Note

(This note is not part of the Order)

This Order makes amendments to Schedule 1 of the Broadcasting (Isle of Man) Order 2003 (S.I. 2003/3193) and Schedule 2 of the Communications Order (Isle of Man) Order 2003 (S.I. 2003/3198). As well as making drafting amendments, the Order also makes further modification to section 54(1)(c)(ii) Broadcasting Act 1996 (as inserted by paragraph 17 of Schedule 1 to, and previously extended by, the Broadcasting (Isle of Man) Order 2003 (S.I.2003/3193).
