CIVIL CONTINGENCIES

The Civil Contingencies Act 2004 (Commencement No.1) Order 2004

The Minister for the Cabinet Office, in exercise of the powers conferred upon her by section 34(1) and 34(3) of the Civil Contingencies Act 20041, hereby makes the following Order:

Citation and Interpretation1

This Order may be cited as the Civil Contingencies Act 2004 (Commencement No.1) Order 2004.

In this Order, “the Act” means the Civil Contingencies Act 2004.

Commencement dates2

The day appointed for the coming into force of the provisions of the Act specified in paragraph (2) is 10th December 2004.

The provisions in this paragraph are—

a

Part 2 (sections 19 to 31);

b

section 32(1) in so far as it relates to Part 2 of Schedule 2;

c

Part 2 of Schedule 2;

d

section 32(2) in so far is it relates to the repeal of Emergency Powers Act 19202 and the Emergency Powers Act (Northern Ireland) 19263;

e

Schedule 3, insofar as it relates to the Emergency Powers Act 1920 and the Emergency Powers Act (Northern Ireland) 1926.

The day appointed for the coming into force of the provisions of the Act specified in paragraph (4) is 19th January 2005.

The provisions in this paragraph are—

section 32(1) in so far as it relates to Part 3 of Schedule 2;

a

Part 3 of Schedule 2.

This Order provides for the coming into force of sections 19 to 31 of the Civil Contingencies Act 2004 (emergency powers) on 10th December 2004. In addition, the repeals of the Emergency Powers Act 1920 and the Emergency Powers Act (Northern Ireland) 1926 are commenced.

The Order also provides for the coming into force of Part 3 of Schedule 2 (minor amendments) on 19th January 2005.
