The Secretary of State, in exercise of the powers conferred upon her by section 40(1) and (2) of the Horserace Betting and Olympic Lottery Act 2004(1) hereby makes the following Order:
1. This Order may be cited as The Horserace Betting and Olympic Lottery Act 2004 (Commencement No.1) Order 2004.
2. In this Order “the Act” means the Horserace Betting and Olympic Lottery Act 2004.
3. Section 11 of the Act (which relates to preparatory work by the Tote) shall come into force on 1st January 2005.
4. Section 12 of the Act (interpretation) shall come into force for the purposes of section 11 of the Act on 1st January 2005.

This Order brings section 11 of the Horserace Betting and Olympic Lottery Act 2004 into force on 1st January 2005. Section 11(1) allows the Horserace Totalisator Board (the Tote) to do anything it, or the Secretary of State thinks is necessary in connection with Part I of the Act (which relates to the sale of the Tote) and related matters. Section 11(2) and (3) requires the Tote Board to comply with requests and directions made by the Secretary of State (after consultation with the Tote Board) in connection with Part I of the Act. The Order also brings section 12 (interpretation) into force for the purposes of section 11 on the same date.
