1.—(1) This Order may be cited as the National Health Service Trusts (Originating Capital) Order 2004 and shall come into force on 31 March 2004.
(2) This Order applies to England.
2. The originating capital of an NHS trust specified in column 1 of the Schedule shall be of the amount specified in the corresponding entry in column 2 of the Schedule.

This Order determines the amount of the originating capital, provided for in Section 9 of the National Health Service and Community Care Act 1990, of NHS Trusts established under that Act between 1 August 2002 and 1 October 2003.
1990 c. 19. Section 9 was amended by section 15 of the Health Act 1999 (c. 8) (“the 1999 Act”). The functions of the Secretary of State under the powers under which this Order is made are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of the National Assembly for Wales (Transfer of Functions) Order 1999, S.I.1999/672 as amended by section 66(5) of the 1999 Act.
