Whereas, the Coventry City Council acting in its capacity as a local education authority (“the authority”) and the governing bodies of the schools comprising the North West Federation of Schools (“the governing bodies”) wish to provide to pupils registered at those schools a course which leads to the International General Certificate of Secondary Education in English awarded by the University of Cambridge Local Examinations Syndicate;
Whereas the authority and the governing bodies have each, in accordance with section 4(2) of the Education Act 2002(1) (“the Act”), consulted such persons as appear to them to be appropriate;
Whereas it is the opinion of the Secretary of State, having regard to the matters set out in section 1(2) of the Act, that the implementation by the authority and the governing bodies of the provisions of this Order may contribute to the raising of educational standards achieved by children in England;
Now, therefore, in exercise of the powers conferred upon the Secretary of State by section 2(1) of the Act, the Secretary of State for Education and Skills, on the application of the authority and the governing bodies, makes the following Order:
1.—(1) This Order may be cited as The Coventry City Council and the North West Federation of Schools (International General Certificate of Secondary Education) Order 2005 and shall come into force on 1st September 2005.
(2) In this Order—
“the 2000 Act” means the Learning and Skills Act 2000(2);
“the Act” means the Education Act 2002; and
“the North West Federation of Schools” means the Sidney Stringer School – Specialising in Mathematics and Computing(3), the Barr’s Hill School and Community College(4) and the President Kennedy School and Community College(5).
2. Section 96 of the 2000 Act shall not, in respect of the provision of a course at any of the schools comprising the North West Federation of Schools which leads to the International General Certificate of Secondary Education in English, apply to the authority or the governing bodies.
3. This Order shall have effect until 31st August 2008.

This Order enables the Coventry City Council and the schools comprising the “North West Federation of Schools” to provide a course which leads to the International General Certificate of Secondary Education (“IGCSE”) in English to pupils at those schools.
The Order is made under section 2 of the Education Act 2002, and in Article 2 exempts the Coventry City Council and the governing bodies of the relevant schools from the requirement in section 96 of the Learning and Skills Act 2000 that the IGCSE in English be approved under section 98 of that Act. Article 3 provides that the Order has effect for a period of 3 years.
