The Army, Air Force and Naval Discipline Acts (Continuation) Order 2005

Whereas a draft of this Order has been laid before Parliament and approved by a resolution of each House of Parliament:

Now, therefore, Her Majesty, in pursuance of section 1(2) of the Armed Forces Act 2001(1), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the Army, Air Force and Naval Discipline Acts (Continuation) Order 2005.

2.  The Army Act 1955(2), the Air Force Act 1955(3) and the Naval Discipline Act 1957(4) shall continue in force for a period of twelve months beginning on the day immediately following 31st August 2005 (which is the date on which those Acts would otherwise expire).

Explanatory Note

(This note is not part of the Order)

Section 1(1) of the Armed Forces Act 2001 provides that the Army Act 1955, the Air Force Act 1955 and the Naval Discipline Act 1957 (“the Service Discipline Acts”) shall expire on 31st August 2002 unless continued in force in accordance with that section.

The Army, Air Force and Naval Discipline Acts (Continuation) Orders 2002, 2003 and 2004 (S.I. 2002/1820, S.I.2003/1869 and S.I.2004/1496 respectively) have each provided for the continuation of the Service Discipline Acts for a period of 12 months. Under the 2004 Order, the Service Discipline Acts shall continue in force until 31st August 2005.

This Order enables the Service Discipline Acts to continue in force for a further period of 12 months beyond 31st August 2005.
