Explanatory Note

(This note is not part of the Order)

This Order makes transitional provision in connection with the coming into force of Part 2 of the Health and Social Care (Community Health and Standards) Act 2003 (“the Act”). Part 2 of the Act is concerned with the establishment and functions of the Commission for Healthcare Audit and Inspection (“the CHAI”), also known as the “Healthcare Commission”, and the Commission for Social Care Inspection (“the CSCI”). The CHAI will now carry out functions formerly carried out by the Commission for Health Improvement (“CHI”) which was established under the Health Act 1999 and which is abolished under the Act.

Article 2 makes transitional provision for CHAI to prepare the annual accounts of CHI for the financial year 2003 – 2004, and for the Comptroller and Auditor General to examine, certify and report on those accounts, and to lay copies of those accounts and his report before Parliament.

(2)

The CHI was established by section 19 of the Health Act 1999 (c. 8), and abolished by section 44 of the Act.
