The Crime (International Co-operation) Act 2003 (Commencement No. 3) Order 2006

The day appointed for the coming into force of the provisions of Part 1 of the Crime (International Co-operation) Act 20031 which are listed in article 3 of this Order has been decided by the Secretary of State and the Scottish Ministers.

The Secretary of State, in exercise of the powers conferred by section 94 of that Act makes the following Order:

This Order may be cited as the Crime (International Co-operation) Act 2003 (Commencement No. 3) Order 2006.

In this Order “the Act” means the Crime (International Co-operation) Act 2003.

Sections 32 to 36 of the Act shall come into force on 1st November 2006.

Sections 42 to 46 of the Act shall come into force on 1st November 2006.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 1st November 2006 the provisions of the Crime (International Co-operation) Act 2003 specified in articles 2 and 3. These provisions implement the 2001 Protocol to the Convention on Mutual Assistance in Criminal Matters. The 2001 Protocol requires participating countries to respond to requests for assistance with locating bank accounts and to provide banking information relating to criminal investigations.
