The Gambling Act 2005 (Commencement No. 3) Order 2006

The Secretary of State makes the following Order in exercise of the powers conferred by section 358(1) and (2) of the Gambling Act 2005(1):

1.—(1) This Order may be cited as the Gambling Act 2005 (Commencement No. 3) Order 2006.

(2) In this Order “the Act” means the Gambling Act 2005.

2.—(1) The following provisions of the Act shall come into force on 31st March 2006—

(a)section 166 (power to resolve not to issue casino licences);

(b)section 349 (duty on licensing authorities to prepare and publish a three-year licensing policy statement).

Explanatory Note

(This note is not part of the Order)

This Order brings into force sections 166 and 349 of the Gambling Act 2005 (“the Act”).

Section 349 requires licensing authorities to prepare and publish a statement of the principles that they propose to apply when exercising their functions under the Act (“a three-year licensing policy statement”). That section is brought on 31st March 2006. Section 166 permits a licensing authority to resolve not to issue casino premises licences under the Act. Any such resolution must be published by being included in the relevant licensing authority’s three-year licensing policy statement. Therefore, this Order also brings section 166 into force on 31st March 2006.
