3. Section 5 of the Act comes into force in respect of special schools in relation to the local education authorities listed in Part 2A of the Schedule and, in respect of primary schools(1), in relation to the local education authorities listed in Part 2B of the Schedule on 1st April 2008.
Primary school is defined in section 5(1) of Education Act 1996.
