The Secretary of State, in exercise of the powers conferred by sections 17A(2) and 114(1) of the Crime and Disorder Act 1998(1), makes the following Regulations:

Citation, commencement and interpretation

1.—(1) These Regulations may be cited as the Crime and Disorder (Prescribed Information) (Amendment) Regulations 2008 and shall come into force on 23rd June 2008.

(2) In these Regulations “the 2007 Regulations” means the Crime and Disorder (Prescribed Information) Regulations 2007(2).

Transitional provisions

2.—(1) The first information period to which these Regulations apply shall be the information period beginning on the 1st April 2008.

(2) The first information period within which information shall be disclosed under the 2007 Regulations, as amended by these Regulations, is the period beginning on 1st July 2008.

Amendments to the 2007 Regulations

3.—(1) The Schedule to the 2007 Regulations shall be amended as follows.

(2) In paragraph 1 for “for 2007/2008” substitute “as at 1st April 2008”;

(3) In paragraph 2 for “the date of these Regulations” substitute “1st April 2008”.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations update the references to the National Incident Category List and the Home Office Notifiable Offences List found in the Schedule to the Crime and Disorder (Prescribed Information) Regulations 2007 to take account of amendments to both documents.

The first information period for which the new definitions will apply is the information period starting on the 1 April 2008. For the quarter from 1 January 2008 to 31 March 2008 the old definitions will apply, although the information does not have to be disclosed to other relevant authorities in the local government area until 30 June 2008.

The latest version of the National Incident Category List in the National Standards for Incident Recording Instructions for Police Forces in England and Wales is available from the Home Office at 2 Marsham Street, London, SW1P 4DF. The Home Office Notifiable Offences List is available on the website http://www.homeoffice.gov.uk/rds.countrules.html.

1998 (c.37); section 17A of the 1998 Act was inserted by section 22 of, and Schedule 9 to, the Police and Justice Act 2006 (c. 48). There are amendments to section 114 of the 1998 Act not relevant to these Regulations.
