Her Majesty, in exercise of the powers conferred upon Her by sections 60 (other than sub-section (3)(r)) and 102 of and Schedule 13 to the Civil Aviation Act 19821 is pleased, by and with the advice of Her Privy Council, to order as follows.

Citation and commencement1

This Order may be cited as the Air Navigation (Amendment) Order 2008 and comes into force on 6th August 2008.

Amendment of the Air Navigation Order 20052

The Air Navigation Order 20052 is amended by inserting after article 167(1)(b)—

c

the competent authority of the United Kingdom for the purposes of Annex III of Council Regulation (EEC) No 3922/91 of 16th December 1991 on the harmonisation of technical requirements and administrative procedures in the field of civil aviation3.

EXPLANATORY NOTE

The Civil Aviation Authority is the competent authority for the purposes of Annex III of Council Regulation (EEC) No 3922/91 (OJ No. L 373, 31.12.91, p.4. Annex III was inserted by Council Regulation (EC) No 8/08 of 11th December 2007, OJ No. L 10, 12.1.08, p.1).

Annex III contains operating rules for commercial air transport aeroplanes including provision for the issue or air operator’s certificates to commercial air transport operators.

An Impact Assessment has not been provided for this Instrument as no impact on the private or voluntary sectors is foreseen.
