Secretary of State may grant certificate42F

The Secretary of State may grant a certificate only if the Secretary of State, in accordance with article 42G, establishes the reliability of the Northern Ireland recipient undertaking.

A certificate must contain the following—
a
the name of the Secretary of State;
b
the name and address of the recipient;
c
a statement that the recipient conforms with the criteria set out in article 42G; and
d
the date of issue and the period of validity of the certificate.

The period of validity of a certificate must not exceed five years.

A certificate may be subject to conditions relating to—
a
the provision of information necessary to verify compliance by the recipient with the criteria set out in article 42G;
b
the suspension or revocation of the certificate.

If the Secretary of State decides not to grant a certificate, the Secretary of State must provide the applicant with written notification setting out the reason for the decision.
