These Regulations, made under section 2(2) of the European Communities Act 1972 (c.68), replace the provisions of Part 3 of the European Public Limited-Liability Company Regulations 2004 (S.I. 2004/2326) (“the 2004 GB Regulations”). They continue the implementation in Great Britain of Council Directive 2001/86/EC (O.J. L 294,10.11.2001, p.22) supplementing the Statute for a European Company (Council Regulation 2157/2001/EC: O.J L 294, 10.11.2001, p.1) with regard to the involvement of employees. The Regulations come into force on 1st October 2009.

In the case of an SE established by transformation, if the rules of a Member State relating to employee participation in the administrative or supervisory body applied before registration, all aspects of employee participation continue to apply to the SE.

Paragraph 13 applies to that end with the necessary modifications.
