These Regulations, made under section 2(2) of the European Communities Act 1972 (c.68), replace the provisions of Part 3 of the European Public Limited-Liability Company Regulations 2004 (S.I. 2004/2326) (“the 2004 GB Regulations”). They continue the implementation in Great Britain of Council Directive 2001/86/EC (O.J. L 294,10.11.2001, p.22) supplementing the Statute for a European Company (Council Regulation 2157/2001/EC: O.J L 294, 10.11.2001, p.1) with regard to the involvement of employees. The Regulations come into force on 1st October 2009.

Where under the provisions of this Part, the competent organ of the SE is to provide information on the employment situation in that company, such information must include suitable information relating to the use of agency workers (if any) in that company.
