The Paymaster General makes the following Order in exercise of the powers conferred by sections 40(2) and (4) of the London Olympic Games and Paralympic Games Act 2006(1):

Citation

1.  This Order may be cited as the London Olympic Games and Paralympic Games Act 2006 (Commencement No. 3) Order 2009.

Provisions coming into force on 5th October 2009

2.  Sections 13 to 16(2) of the London Olympic Games and Paralympic Games Act 2006 shall come into force on 5th October 2009.

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings sections 13 to 16 of the London Olympic Games and Paralympic Games Act 2006 into force on 5th October 2009.

Section 13 directs that a local highway authority, local traffic authority or street authority must notify the Olympic Delivery Authority before exercising any function that may have an impact upon the Olympic Travel Plan, Olympic Route Network, a London Olympic Event or any other travel related to the London Olympics.

Section 14 provides that the Olympic Delivery Authority may, with the consent of the Secretary of State, make an order relating to roads forming part of the Olympic Route Network as if it were a traffic authority in respect of that road, in so far as it does so in order to implement the Olympic Transport Plan or facilitate transport services in connection with the London Olympics.

Section 15 sets the maximum fine for contravention of an order made under section 14 at level 5 on the standard scale, and deals with other matters relating to enforcement, including provisions from Part 6 of the Traffic Management Act 2004(3).

Section 16 applies section 16A of the Road Traffic Regulation Act 1984 (road closures or restrictions for certain events)(4) to the London Olympics.

2006 c.12. By article 3(1) and (2)(d) of S.I. 2007/2129, the functions of the Secretary of State under section 40(2) and (4) are exercisable concurrently with the Paymaster General.

By section 41(1) and (3) of the London Olympic Games and Paralympic Games Act 2006, sections 13 to 16 extend only to England and Wales and apply only in relation to places in England and things done in or in respect of England.
