The Secretary of State in exercise of the powers conferred by section 148(4), (5) and (10) of the Local Democracy, Economic Development and Construction Act 2009(1), makes the following Order:

Citation

1.  This Order may be cited as the Local Democracy, Economic Development and Construction Act 2009 (Commencement No. 1) Order 2009.

Commencement in England and Wales

2.  The following provisions of the Local Democracy, Economic Development and Construction Act 2009 come into force in England and Wales on the day after this Order is made:

(a)section 69(3), (6), (7) and (8) (local authority economic assessment);

(b)section 71 (Leaders’ Boards);

(c)sections 84 (guidance and directions), 86 (regulations) and 87 (interpretation).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order commences provisions in Parts 4 and 5 of the Local Democracy, Economic Development and Construction Act 2009. The effect of the commencement of the provision in Part 4 is to enable the Secretary of State to consult local authorities and other bodies in England about proposed guidance to be issued in relation to the duties that are to be imposed on those authorities to prepare assessments of the economic conditions of their areas.

Part 5 of the Act makes provisions for regional strategies (to replace the existing regional spatial strategies) and for “Leaders’ Boards” to be established for the purposes of Part 5. Commencement of sections 71, 84, 86 and 87 enables participating authorities to establish Leaders’ Boards in advance of the commencement of the Part as a whole. Participating authority is defined in section 71(3) of the Act.
