Coming into force
The Secretary of State, in exercise of the powers conferred by sections 15(1), (2), (3)(a), (4) and (9) of, and paragraph 15(1) of Schedule 3 to, the Health and Safety at Work etc. Act 1974 1 (“the 1974 Act”), and for the purpose of giving effect without modifications to proposals submitted to him by the Health and Safety Executive under section 11(3) of the 1974 Act after the carrying out by the said Executive of consultation in accordance with section 50(3) of that Act, hereby makes the following Regulations:
Citation, commencement and interpretation1

These Regulations may be cited as the Health and Safety Information for Employees (Amendment) Regulations 2009 and shall come into force on 6th April 2009.

In these Regulations “the 1989 Regulations” means the Health and Safety Information for Employees Regulations 19892.
Amendment of the 1989 Regulations2

The 1989 Regulations are amended as follows.

In regulation 3(3) for “nine months” substitute “five years”.

After regulation 5(1)(b) insert the following—
; or (c) information as to how any of his employees may obtain the information referred to in (a) and (b) above.

; or (c) information as to how any of his employees may obtain the information referred to in (a) and (b) above.
Extension outside Great Britain3
These Regulations shall apply to and in relation to premises and activities outside Great Britain to the same extent as provided for in regulation 2(5) of the 1989 Regulations.
