The Secretary of State makes the following Order in exercise of the powers conferred by section 370 of, and paragraphs 5(2), 6(2)(b) and 12 of Schedule 15 to, the Armed Forces Act 2006(1):
1.—(1) This Order may be cited as the Armed Forces (Civilians Subject to Service Discipline) Order 2009 and comes into force on 31st October 2009.
(2) In this Order “the Act” means the Armed Forces Act 2006.
2. The organisation listed in Schedule 1 is specified for the purposes of paragraph 5 of Schedule 15 to the Act.
3. The organisations listed in Schedule 2 are specified for the purposes of paragraph 6 of Schedule 15 to the Act.
4.—(1) The areas listed in paragraph 1 of Schedule 3 are designated for the purposes of paragraphs 4, 6 and 9 of Schedule 15 to the Act.
(2) The areas listed in paragraph 2 of Schedule 3 are designated for the purposes of paragraph 8 of Schedule 15 to the Act.

1. The following are designated areas for the purposes of paragraphs 4, 6 and 9 of Schedule 15 to the Act—
Brunei Darussalam
the Falkland Islands
the Federal Republic of Germany
Gibraltar
the Kingdom of Saudi Arabia
the Islamic Republic of Afghanistan
the Republic of Iraq
2. The following are designated areas for the purposes of paragraph 8 of Schedule 15 to the Act—
Belize
Brunei Darussalam
the Falkland Islands
the Federal Republic of Germany
Gibraltar
the Kingdom of Saudi Arabia
the Republic of Cyprus
the Republic of Turkey
the Sovereign Base Areas of Akrotiri and Dhekelia
the State of Kuwait
the Sultanate of Oman

Under the Armed Forces Act 2006 certain persons may, for the purposes of the Act, be “civilians subject to service discipline”.
Whether a person is a civilian subject to service discipline depends in some cases partly on whether he is a member or employee of a specified organisation.
Article 2 and Schedule 1 provide for the specification of the military organisation (the North Atlantic Treaty Organisation) certain of whose members or employees are civilians subject to service discipline when outside the British Islands.
Article 3 and Schedule 2 provide for the specification of those other organisations whose employees are civilians subject to service discipline when in a designated area.
Some categories of person are civilians subject to service discipline if they are in a designated area. Article 4 and Schedule 3 provide for the designation of areas for the different categories.
